this video has me thinking what happens if youre completely sober and faint at the wheel with no previous health conditions and strike someone with your car and kill them. is that still murder

(I'm not a lawyer or cop or anything but I have some basic formal education with criminal justice and medical systems in North America.) If we assume that the driver was in fact unconscious (and not just saying so as a defense), then murder is not applicable as Asphodel7 said. But I would respectfully disagree with Asphodel7 in that I think manslaughter is also not applicable. For a criminal offense to occur, you need both "a guilty act" (i.e. the accident itself which means this condition is met) AND "a guilty mind" (either intention, malice, negligence, or ought to have reasonably known better). The guilty mind criterion is not met if the driver is unconscious because the unconscious person does not have the ability to act with malice, intent, or negligence because they are unconscious.

However, if the driver is unconscious due to a previously diagnosed medical condition (such as epilepsy, narcolepsy, or insulin-dependent diabetes which can cause unconsciousness due to low blood sugar) and they were advised by a doctor or judge not to drive and they drive anyways and experience an episode of unconsciousness, then they can be held criminally responsible because they ought to have reasonably known better than to drive but drove anyway.

Hope this made sense. This was written from a North American perspective so local laws may be different. Also I'm not a lawyer or cop so I may be wrong but this is my understanding.

It'd probably be vehicular manslaughter or some form of charge from an unintentional action that caused an accident that resulted in death. It'd definitely be considered killing someone, but I don't think it would be murder. Murder means the killing was intentional, whether pre-meditated or spur of the moment. But that's just my thoughts on it.
