Boats have the right of way over jet-skis, plus the boat and tube were visible and moving in a straight line.
Knowing jet-skiers, they were planning to hit the wake but weren’t paying attention and got surprised by the tubers.

As someone who got a boater safety license at 11 years old and grew up on a lake I’d have to say the boat operator should have kept the tube inside his wake until the ski passed. I’m sure all parties feel terrible and the ski operator had better been sober.

Idk who would be at fault here but I grew up on a lake being pulled around as a kid. You gotta be aware of everything around you like other watercraft as well as stumps just below the surface. The jet ski couldn’t anticipate the movement of the tube. The boat operator should have kept the tube inside the wake until the ski passed.
