There's a difference between involuntary convulsions and ‘function'. Nothing about this guys brain is functional anymore. Most of these involuntary actions come from the brainstem and not the brain itself anyways. This is textbook agonal respiration. It's literally the exact same thing fish do when you remove them from oxygenated water and into atmospheric air which their gills (fish lungs basically) are not capable or compatible to function with.

Its a shot (..or something else idk) through the face.. so the facial skull is mostly affacted. The neurocranium (and the brain within) could be primarily unaffacted. Perhaps a little bit of the left temporal lobe an thalamus could be in the way of the shot. But medulla oblongata is still in tact hence he is breathing which also means he is not dead ..yet.

.... what you can see here is called agonal breathing or gasping. Its a type of abnormal breathing pattern that occurs particularly during the dying process. It is characterized by slow irregular, and gasping breaths that may seem involuntary and labored.
for example when some suffers a cardiac arrest, severe brain injury.... the body struggles to maintain oxygen flow to the vital organs, even when the brain's higher centers have been compromised.
So in fact. he is in the process of dying (if not treated - intubation, machine ventilation and so on)... and it does not look like that this would happen to him soon (and also it does not look like it would help in the end anyway) but i could be wrong. i am not a neurosurgeon ^^
