I voted yes because I think if a shark doesn't consent it's going to let you know very quickly.

So the question seems less bounded by the intellectual abilities of sharks per se, and perhaps more reflective of animal intelligence in general. I think you may need to perform some empirical tests. Please let us know your results (particularly if it involves WPD-appropriate videos/images).
