Former police officer executed in a parking lot in Rio

Rio City, RJ, Brazil - May 19, 2023

A former military police officer was executed inside the parking lot of American Pet, on Geremário Dantas Avenue, in Jacarepaguá neighborhood, in the West Zone of Rio, this Friday afternoon (19). A video shows the action of criminals. According to the police, André Elias Pereira de Oliveira, known as Deco, was a former PM and involved in the Rio das Pedras neighborhood militia.

According to the PM, two hooded men fired several shots at the victim around 3:40 pm. He died at the scene and no one was arrested. The Capital Homicide Police Station (DHC) was triggered and carried out an on-site investigation. Efforts are underway to identify the author of the crime.

Deco was a military police officer and was expelled from the corporation in 2014 for involvement with the militia. He had been arrested in 2009 in Operation Rolling Stones, carried out by the Police Station for the Repression of Criminal Actions and Special Inquiries (Draco).

Deco was arrested and benefited from a decision André got a decision in his favor thanks to a presidential decree by Bolsonaro in 2019. In 2016, the former PM was caught with a loaded 9mm pistol – a weapon that became allowed to be used after the presidential decree –, 12 12 caliber cartridges and a Taurus .380 pistol, also loaded.

The complaint against the former PM also said that inside his car the police found a bulletproof vest and a wooden baton. In the 1st instance, Deco was not convicted, but, in April 2019, the Rio Public Ministry (MPRJ) appealed the decision and managed to get the Third Criminal Chamber to punish Deco to 4 years and 6 months in prison in a semi-open regime. The preventive arrest warrant against Deco was fulfilled by agents of the 41st DP (Tank) in September 2019. On December 11, when judging the criminal review request made by Deco's defense, the Fourth Group of Criminal Chambers "disqualified" the conduct attributed to him and reduced the final sentence to 3 years and 4 months of imprisonment.

The change in conviction was considered thanks to one of the presidential decrees: "[...] Recently, 9mm Luger caliber weapons and ammunition - 9X19mm are no longer restricted to use, becoming permitted" wrote the judge Adriana Lopes Moutinho.

As rapporteur for the case, the magistrate then determined that Deco's imprisonment be replaced by two sentences restricting his rights and gave an order for the release of the former PM to be issued.
