The Byron Smith Recording.

-FULL 30 MINUTE RECORDING BELOW-

Byron David Smith was a 65 year old retired security engineering officer with the US State Department.

He was residing in Little Falls, Minnesota in 2012 when his home had been broken into half a dozen times.

Eventually, Byron had enough of these routine break-ins and set up security systems, including four different security cameras set up around his property.

Some of the things stolen from Byron include but are not limited to:

Thousands of dollars in cash.

3,000$ camera

His metals and ribbons from the war of vietnam.

His father's P.O.W wristwatch.

On the day of thanksgiving, 2012, Byron Smith parked his truck away from his home, giving the appearance of an empty house.

He then withdrew to his basement with a rifle and a .22 caliber handgun and laid in wait for the theives.

Approximately 1 hour later, 17 year old Nicholas Brady, and his 18 year old cousin Halie Kifer begin to case the home.

Nicholas eventually enters the home by shattering a window which can be heard in the full length recording.

After some meandering upstairs, Nicholas descends the basement stairs, and is shot three times by Byron Smith, after shooting the teenager, Byron can be heard uttering a rather callous remark to the deceased victim: "You're dead."

Byron can then be heard dragging Nicholas's deceased body into a workshop room at the bottom of the staircase.

10 minutes later, the voice of Halie Kifer is heard calling out the name of her cousin: "Nick?"

She then begins to descend the basement stairs. Byron fires 1 shot at Halie, causing her to go tumbling down the stairs.

His rifle then jams, and once again Byron can be heard taunting the half dead duo: "Oh, sorry, did i do that?"

Halie can be heard screaming and saying: "Im sorry!" before Byron takes out his .22 revolver and shoots the teenager 4 times in the chest. As he is shooting the teen, he is again taunting them, saying: "You're dying."

He then can be heard dragging Halies body in to the same workshop where her cousin is. Byron realises that Halie is still breathing, to which he responds by placing the revolver directly under her chin and pulling the trigger.

No sympathy for those thieves. It's sad to see someone who fought with their life for a country's citizens to then turn around and rob an old man's house repeatedly. Especially things that were irreplaceable. I wish the best for the old dude, he has suffered enough.

He’s going to die in prison - which is good and proper, as he didn’t have to execute those two teenagers. He’s definitely a stupid man, too.

He should’ve simply had these kids arrested, and waited for an armed intruder, in which case he would’ve sated his psychotic lust for revenge AND enjoyed living the rest of his life outside of a small cage.

Defend yourself with a gun all you want, but if you want to start executing incapacitated people, maybe don’t start with two teenagers who absolutely did not deserve to die.

This guy shouldn’t have been all creepy and executing them like that, but if you enter my home without permission in an attempt to take things from me I’ve worked hard for, then that’s your choice, and my choice is to defend my home and possessions. Yeah honestly if he wanted to kill robbers in his house there were better ways of going about it legally, provided the robbers were literally breaking into your house already, ends don't justify the means here I suppose. If you break into someone’s house you might get shot. That’s the dice you roll. Two sides of a coin here. They probably deserved to be shot, but at the same time this guy set a trap for sure. The recording was a bit sadistic and not needed. Probably swayed the jury to their decision. That’s a rough case.

Had every right right to take action once they were on his property illegally. Did not, however, have the right to execute the girl like he did. That wasn’t self defense or protecting his property. That was cold blooded murder. Anyone who thinks different should re-evaluate what they think a human life is worth.

Moral of the story: don’t break into people’s homes. As well as don’t execute teenagers who you’ve already incapacitated. And if you are planning to do the latter, sure as hell don’t leave audio evidence of you doing it.

This was really interesting! I love the depth you can feel to things when you're forced to really listen to them. Are there any other good audio clips running around like this? I know of one where a guy steals a plane and talks to air traffic control until he crashes but this is completely different.

You don't seem to understand Castle Doctrine. It is not a license to kill and be judge, jury, and executioner on your property.

It is a right to defend your property. He was probably in the clear until he executed her with that last shot.

You are the one that doesn’t seem to understand what Castle Doctrine is. For starters, in most states you are not allowed to use deadly force to defend property, whether it’s in your house or not.

Castle Doctrine basically means you don’t have a duty to retreat when in your own residence and can use deadly force to protect your life (not necessarily your property although some states allow that).

Stop making shit up dude. Castle Doctrine is not about defending property.

His mistakes were:

  1. Not calling 911 immediately after the shooting

  2. Recording himself, which was later used against him to establish intent (the bulk of his conviction was based on this)

He had every right to use deadly force and kill them, and they were serial criminals/drug addicts and the world is better off without them anyway. He shouldn’t have recorded himself and he should have called 911 right away. He was convicted because he effectively lured criminals to his property with the intention to kill them. In my book if you fall for a trap like that I’m ok with you getting shot.

Well, I didn’t say Castle Doctrine allowed you to kill a non-threat. To be clear, Castle Doctrine doesn’t even protect you if you kill someone guilty of nothing but trespassing. But I didn’t say what you are suggesting I said, you are being dishonest.

Let me be even clearer:

The people that got shot were drug addicts who were known thieves. They were tied to other burglaries around the area. They were not good people or anyone who deserves our concern or attention even. Anyone killing them would be providing their community with free community service. We don’t even need to factor in the fact that the guy was a war hero and clearly someone who did actually deserve our concern and attention.

The guy that did this tremendous act of community service could have gotten away with it, covered by Castle Doctrine, but he fucked up in the ways I outlined above. The jury didn’t really make a mistake -they did in fact follow the law-, but that doesn’t mean an injustice wasn’t perpetrated by incarcerating an otherwise decent man for technically luring two subhuman pieces of shit and killing them.

He shouldn’t have recorded himself, he should have called 911 immediately but he was 100% right in mag dumping on those pieces of shit and it’s a damn shame he is in prison over them.
