During and a little bit after the magdump the guy on the ground fires his gun, one round hit the store gaurd in the leg. I'm sure the gaurd was in oh shit oh fuck mode from being shot so instead of reloading he came back with the shotgun to win.
His intent was definitely to kill him. First round was a missed headshot. Watch in .25, you can see the miss on the glass. Dude probably lost his confidence in his pistol for a moment and decided on the shotgun.
