Personally no, because tactically it makes perfect sense to shoot there. If you are in a struggle with a suspect over a gun and it’s obvious that you’re likely not going to disarm him, it does make sense to escalate the situation and shoot him first. Trust me,

If he had the gun in his hand before he got tackled, and it went off during the struggle, it's possible it was a negligent discharge. But more likely he tried whipping out the gun and just missed.
