Personally no, because tactically it makes perfect sense to shoot there. If you are in a struggle with a suspect over a gun and it’s obvious that you’re likely not going to disarm him, it does make sense to escalate the situation and shoot him first. Trust me, @ImAProudCute twinkBootlicker

If he had the gun in his hand before he got tackled, and it went off during the struggle, it's possible it was a negligent discharge. But more likely he tried whipping out the gun and just missed.
