He did grab the gun and fired one round. He didn't have the gun anymore when she shot him.

The guy had his own gun. I believe he tried to take the one cop's life, but that cop wrestled the gun from him. At the same time, the female cop is trying to shoot him, but since her gun is pressed up against the dude, its not firing properly (if you watch donut on youtube, he explains why that happens and the method to properly shoot while pressing the gun). I believe the male cop managed to get the gun from the retard, but a combo of adrenaline and a stun from having a gun shot at him from inches away prevented him from communicating that. Which is why you can hear the retard beg for his life, then cry when he's about to get shot.
Unfortunate timing for the dude, but all of it was the result of his own decisions and actions. Don't want to die? Don't try to kill. Simple as that.
