That’s gotta be the absolute worst luck, to not only have your foot just barely run over by someone not paying attention to pedestrians, but to also have the next car that approaches be so fucking oblivious that they don’t think “hey, why the hell did the other cars stop moving and start honking?” The black SUV cut the guy turning right off for Christ’s sake, that guy’s an asshole whether or not someone was even run over.

It’s important to remember the driver’s POV is not anywhere near the same as what we see on camera. His or her attention was likely focused on the other moving vehicles (as would normally be prudent) and (along with the low-light conditions) may not have been looking in the direction of the fallen man until he was so close the relatively high front of his vehicle blocked any direct view of him. I mean, the driver may well be culpable of some type of offense, but I doubt you could convince a jury the driver knew the man was there but just decided to drive over him anyway.

The field of human factors, particularly in terms of visual perception and attention, is really fascinating IMO (and particularly humbling) in terms of how little we really notice during our daily/routine activities. Might be true, but you're completely missing the point. The driver is supposed to pay attention to where he's going, if he doesn't then he is 100 % to blame and a fucking moron who's license should be revoked.

Every court needs a prosecutor, and your stance is exactly what I would be arguing in those shoes, so in that sense I can most certainly respect where you are coming from. There is a balance between the allowance we should permit for human attentional/perceptional/cognitive fallibility and the social obligations necessary for a reasonably safe society. I do not presume to know where those lines are to be drawn.

Agreed, easy to say you know what you would have done, when you aren’t driving in the dark in this situation. Doesn’t help that the white car didn’t stop to mark where the man had fallen. But that’s assuming the white car saw this. This is why I always am absurdly careful when crossing streets

Even if the pedestrian was wearing a fucking invisibility cloak, black suv saw the red car stop and assumed they were giving way but when the red car started honking they really should have stopped for at least a second.

And then they kept going forward and hit something.

If I was driving in NYC, at night, at an intersection, and felt my car run over something, I’m not thinking there’s a speed bump or some shit in the middle of the intersection. Any reasonable person would immediately have one word in their head; “person”.

So when you hit them, and then slowly keep rolling forward, listening to all the cars around you honking, feeling the thing go past both sets of wheels one after another, and still fucking continue driving
