as least in USA, that's a good thing, as this is clearly self-defense (he's literally backing away from them the whole time, and 2-to-1 fight), if they over-charge the crime it's easier to find not-guilty and they can't retry him for a lesser crime.

What you said is correct. Unfortunately he is in Australia and I don’t think they have a right to self defense a la America and he is more than likely fucked. I’d say his chances of being convicted of actual murder are around 70%, which is of course unjust and unfortunate.

its even more unfortunate because if knife guy didn't have the knife, and walked away, the guys wouldve jumped him and mightve left him brain dead. he never turns his back to the 3 guys charging towards him bcuz he knows even walking away won't appease them

The implication is that the dude was supposed to call the cops, wait until they got there and let them handle the altercation, presumably with firearms or some kind of weapon.

According to the legal fiction peddled by these countries as law, that dude had a moral and legal obligation to allow multiple people to assault him -which would for sure inflict serious harm and could potentially killl him- and avoid using deadly, albeit defensive, force to protect his life.

So, don’t defend yourself, your life doesn’t matter, let them beat you up and pray that the cops get there in time even though we all know they couldn’t and won’t.

This is some truly barbaric shit, it’s a shame that very few countries get this issue right.

hopefully one never needs to be in a situation where lethal force is necessary to defend one's life. but growing up in the USA, you quickly learn the nuance and what constitutes legal self-defense. wait for the other guy to make a threatening move, only react as much is necessary to defend your life, then retreat if you can. sometimes even after you stop, the other person might keep coming for you, so its like "ok, gotta wait again until they make a threatening move" to stay within the bounds of the law. if you defend yourself, then keep wailing on the person or knock them out then end up stabbing them or something, you'll be charged with manslaughter or murder. so in these hyper adrenaline situations, controlling rationality over emotions is critical to avoid jail time

Super necro-posting but one of my old firearms instructors straight up told the class that if you’re ever in trouble or even THINK you might be in trouble and you’re anywhere remotely near other people, regardless of what weapons you have or don’t have, raise absolute hell. Get all eyes on you and make sure as many people as possible are watching what’s going down. That alone might be enough to make an attacker fuck off.

Obviously that’s only one small part of a self-defence plan, but it’s nonetheless valid.

australian here. we do have self defence rights here but they have to be proportional to the threat involved, and being that carrying any type of weapon in public (regardless of your excuse) is illegal, he’d be the one culpable for his death

If you are not allowed to carry a tool -forget a gun, not even a knife- to protect yourself with in the unlikely event you are attacked by one or multiple assailants then you do not, in fact, have any self-defense rights at all.

When we speak of the right to self defense we are talking about the right to take the actions necessary to secure one’s well being and life from those who initiate the use of force against us. You are not allowed to take the necessary steps to do that then you do not in fact have right to self defense.

You are probably talking about a certain permission to defend yourself under a very limited context, arbitrarily granted by the state, but not per se a “right”.

But do you understand what I am sayin? It’s kinda incoherent to say there’s such a thing as a right to self defense in Australia when even carrying a knife to potentially defend your life is a crime. I’m from Mexico and it’s the exact same way there, it’s absurd, immoral and irrational.

You’re right bro if the other guy had a bigger knife then you would want a gun! :) That’s having the right to defend yourself I love the US! I stay in the UK where knife crime is a big problem and carrying a knife in public is illegal m. I would love to have a gun to have the right to defend myself cause you never know what or who is around the corner.

So if you have concealed carry and you are put in a situation where you have to use it means you premeditated murder? That’s the whole point of carrying. To defend yourself. It’s not that you’re out looking for a reason to kill someone. But it’s better to be prepared in case you are in danger. I also carry a pocket knife with me every day.
