I think it depends on the US state you're in entirely. I live in a US state where this is taken very seriously. You'd have to have a good lawyer and no criminal record to even have a chance. I had a couple of buddies locked up in high school for the same kind of shit, they are still serving a prison sentence. It wasn't life, but about 10-20 years. The amount of time they took from their classmates I suppose...

Well, at that point, you're messing with a crime scene- that's the thing, if you rolled up on this scene, you assume it's some tragic accident, you'd probably give the young driver the benefit of the doubt.
But the reality- That scene needs to be investigated so that the driver can be thoroughly brought to justice.
